Busch Law Offices Refuses to Settle, Achieves Victory for Client

Busch Law Offices represents an out of state claimant who needed a three level cervical fusion. Our client's surgeon stated that the integrity of his spinal cord was at risk of serious injury due to the work-related condition in his neck. The surgeon requested authorization from the insurance company, which was promptly denied after a cursory record review by the insurance company's hired physician.

Busch Law Offices initiated litigation and sent our client for an independent medical exam (IME). In the meantime, the insurance company pushed hard for settlement, but Busch Law Offices refused to participate in two scheduled settlement conferences because of the insurance company's terms that were made aware to us prior to each conference.

Two days after Brett Busch deposed the IME physician, he received a call from opposing counsel informing us that his client, the insurance company, decided to admit liability and pay for the surgery our client desperately needs. This procedure probably costs in excess of $275,000 for cash payers. It is likely that the insurance company would have settled this case for an amount close to this. Rather than take the large fee, Busch Law Office vigorously pursued authorization for the surgery, advanced a significant amount of money in expert fees, and got what our client deserved without the need for a hearing and without settlement and waiver of our client's rights under his workers' compensation claim.
